bad accident

    This is an old post but I thought I would update.

    It has been six months and I finally rode my bike again. It was nice to get out. I was not sure I was ready since my feet get sore if I just stand a few hours but the boots really make it so the feet and ankles don't do much. My feet did not hurt any more then normal afterwards but I sure was careful not to smack then into anything during the ride. The movement is not 100% in my right ankle which makes getting on the brake fast hard. I am really thinking of an auto clutch and LHRB now.

    Hopefully I can be up to full speed in a couple months. I never thought it would take this long to recover. My back has been bothering me but it has never been real great and I think the way I walk now is agrevating it. I will go back to the doctor just to make sure.

    The guy who hit me did know he was suffereing from seizures. I have no idea why he was driving but there is not much debate about who was at fault. Still having a air tight claim is not like winning the lottary as some would think. The minimum liability people have to hare is real low, like 25k, and of couse he had the minimum. Fortunetly I have more then that in uninsured/underinsured coverage. Some day I should get enough for a new bike and some toys but it will not be nearly enough to make up for all this.

    I am happy to be getting better though. Hopefully with a few more months and effort at the gym the feet will work as good as they did before the injury.

    Thanks for the update. I remember getting on the bike after being off for several months with an injury, it was an interesting experience.

    Recovery can be slow, and I completely understand how these types of liability situations works.

    Excellent news NWRider :thumbsup: Glad to hear you were able to get back on the bike after only 6 months! I'm surprised to hear it, as I figured the severity of your injuries would keep you off the bike longer than that.

    I've had numerous injuries over the years that have kept me off the bike for up to a year, and it is always weird getting back on for the first time. The injury is always in the back of your mind, for sure. For me, that kind of apprehension has always gone away over time, though, and then I'm free to injure myself again :busted:

    I think you're right about walking weird having an effect on the health of your back. I've experienced that very thing after limping due to knee surgeries and broken ankles/feet. It all goes hand in hand.

    You might want to take a serious look at the PivotPegz. They did wonders for me when I started riding again after breaking my ankle and getting all that metal put in. I had no range of motion whatsoever, and the PivotPegz helped tremendously. I can't hardly ride without them now:) They're a great product for folks like us.

    Glad to know that you're healing and were able to get back on the bike.
    Just because his insurance is minimum coverage doesn't mean that there is no more left on the table. You can sue him directly for any sum that the court would deem reasonable and likely win (assuming that you didn't sign any waivers of future liabilities). Collecting on the lawsuit might be another story but it is another possibility.

    Great to hear that you are getting back into near riding condition. :thumbsup:

    You first need to exhaust your underinsured/uninsured coverage. It is up to your insurance company to retrieve anything they can get out of the other guy. At the point that you exhaust your insurance and his pitance of liability then you can consider going after his assets. Unless he has a large nest egg, I doubt that you are going to realize anything positive from a lawsuit for his personal assets. JMO

    Most insurance companies take your coverage limits and put them in an account and then make you jump through every possible time delaying hurdle before they send you the check. Just the way they do business. They are in the business of denying coverage and payment. You will also want to wait to make your claim until the doctor releases you with a full recovery. Your attorney knows all this and is the one to listen to.

    Keep healing and get out there and ride.

    I was wondering the other day how you were coming along. Glad to hear you are back in the saddle. Your bike looked like it had alot of life left, so hopefully it'll last till things get worked out.

    I would love to take it for a ride. I am afraid I would slow you down quite a bit (more than I normaly would). If you are heading out with some slow or new riders and the pace will be down I would like to come along.

    don't worry about it, it's a trail ride. SX this weekend in Seattle but might be able to get out Sunday if you want.

    Back in 06 I had one helluva crash...shattered pelvis...broken ribs.. punctured lung...lost a kidney....and bruised a few other organs etc..it was a bad deal

    I was back riding in two months....I didnt have to...but with winter setting in.....I though I better get on with things...or I'd be waiting along time wondering about the future....

    Wow, what an ordeal. Good to see you can get back to something you enjoy.

    A note to add to wallybeans post. Even if you exhaust your underinsured limit, and were able to go after the at fault persons assets, the insurance company often has the right to recoup their money first. Look up subrogation...............
